The Terms of Use stated herein (collectively, “Terms of Use” or “Agreement”) constitute a legally binding agreement between you and Baristopia (M) Sdn.Bhd. ("Company")
1. Acceptance of Terms
Welcome to Baristopia ! By using our mobile application ("Application") and accessing or using any of our services ("Service"), you agree to be bound by these Terms of Use. If you do not agree with these terms, please do not use the Application or the Service. These Terms of Use apply to all users of the Application and Service.
2. Use of Service
By using the Service, you represent and warrant that you are of legal age and have the legal capacity to enter into this Agreement. If you are using the Service on behalf of a company or other legal entity, you further represent and warrant that you have the authority to bind such entity to these Terms of Use.
In order to use certain features of the Service, you may be required to create a user account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and are solely responsible for all activities that occur under your account.
Violating any applicable laws or regulations. Posting or transmitting content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable. Attempting to interfere with the proper functioning of the Service. Using the Service to transmit viruses, malware, or any other harmful code. Violating the intellectual property rights of Baristopia or any third party.
3. Intellectual Property
The Application, Service, and all content and materials provided therein are the property of Baristopia and its licensors. All rights, title, and interest in and to the Application and Service are and will remain the exclusive property of Baristopia and its licensors.
Baristopia grants you a revocable, non-exclusive, non-transferable, limited license to access and use the Application and Service for personal, non-commercial purposes. This license does not grant you any rights to use Baristopia's trademarks, logos, or other proprietary branding elements.
4. Privacy
Baristopia may collect and process certain personal information from you as described in our Privacy Policy. By using the Service, you consent to the collection and processing of your personal data as outlined in the Privacy Policy.
5. Termination
Baristopia reserves the right to terminate your access to the Application and Service at any time and for any reason without prior notice. In case of termination, your right to use the Application and Service will immediately cease.
6. Disclaimer of Warranties
The Application and Service are provided on an "as-is" basis, without warranties of any kind, either express or implied. Baristopia disclaims all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation of Liability
In no event shall Baristopia be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Application or Service. Baristopia's total liability to you for any claim arising from or related to the Service shall not exceed the amount paid by you, if any, for accessing the Service.
8. Governing Law and Dispute Resolution
These Terms of Use shall be governed by the laws of Malaysia. Any dispute arising from or relating to the Service shall be resolved through arbitration administered by Asian International Arbitration Center ("AIAC") in accordance with its rules. The seat and venue of arbitration shall be Kuala Lumpur, Malaysia. The language of arbitration shall be English.
9. Changes to Terms
Baristopia reserves the right to modify or update these Terms of Use at any time without prior notice. The most current version of the Terms of Use will be made available on the Application. Your continued use of the Application and Service after any changes to the Terms of Use constitutes your acceptance of the revised terms.
